Charles Diamond

He was arrested with another man on 25 August 1980, while the two were having sex in David Balfour Park (#DBP). On 19 December 1981 both men were acquitted of the charge of “wilfully committing an indecent act in a public place, in the presence of one or more persons.” The presiding judge, Milton Cadsby (#MCAD), argued that the men had sought privacy. This was the lesser charge, however, and the men were immediately charged with gross indecency. Diamond decided to fight this charge, while the other man pleaded guilty. On 25 January 1982 Diamond defended himself by raising the issue of double jeopardy and claimed that he was being charged twice for one alleged offence. The judge, W.F.B. Rogers (#WROG) agreed, and dismissed the charge.
