He was charged with gross indecency when at the age of twenty-one when he was caught kissing Dean Solomany (#DSOL) in Queen Elizabeth Park in Edmonton on 3 December 1976. GATE Edmonton started a Holowaty/Solomany Defence Fund to fight the charges.
